Terms of Service and Refund Policy

These Terms of Service ("Terms") govern access to and use of the online courses and related services offered by AMI Data & Solutions GmbH trading as GermanyFastlane and SpeedyGerman ("we", "us", "our"). By purchasing or using our courses, you agree to these Terms.

2. Scope and definitions
These Terms apply to all distance contracts for our digital courses and materials.
Digital content means data created and provided in digital form.
Platform means our course platform, currently Thinkific or a successor platform.
3. Eligibility and accounts
You must be at least 18 years old and have legal capacity to purchase. You are responsible for safeguarding your account credentials and must not share them. We may suspend or terminate access if misuse or payment issues occur.
4. Course access and licence
When you purchase a course, you receive a personal, non-transferable, non-exclusive licence to access the course materials for your own learning. You may not share, resell, copy, publish, distribute, or otherwise make the content available to third parties.
Where we refer to “lifetime access,” this means access for as long as the relevant course is offered and maintained by us, with a minimum access period of 24 months from the date of purchase. Lifetime access does not mean access for the lifetime of the customer and does not guarantee the permanent availability of any specific course platform, app, technical feature, or third-party service provider.
If we retire a course before the minimum access period expires, we will provide an equivalent replacement, continued access through another suitable method, or a pro-rata refund.
5. Prices, taxes, and payment
Prices are shown including VAT where applicable. We sell exclusively to consumers as defined in §13 BGB. We do not offer VAT-exempt B2B sales or apply the EU reverse charge mechanism, even if a VAT number is provided at checkout. All orders are processed as consumer purchases. For EU consumers, VAT is charged according to your location under One Stop Shop rules. Payment is due in full before access is granted. We may change prices for future purchases.
6. Contract formation
By placing an order on our checkout page and clicking the purchase button clearly labelled to indicate an obligation to pay, you make a binding offer. We accept by confirming your order and granting access. The contract language is English.
7. Delivery and availability
Delivery is by immediate online access, streaming, or download.
Our courses are delivered through online platforms and third-party service providers, including course hosting platforms, video hosting providers, payment processors, email systems, analytics tools, and other technical service providers. The current course platform is Thinkific, but we may change, replace, or migrate to another platform or delivery method at any time for technical, legal, commercial, security, or quality-related reasons.
We aim to provide reliable access to purchased course materials, but we do not guarantee uninterrupted, error-free, or permanent availability of any specific platform, technical system, feature, app, or third-party service. Temporary interruptions may occur due to maintenance, technical issues, security measures, third-party outages, force majeure, or circumstances outside our reasonable control.
If the current course platform becomes permanently unavailable, is discontinued, or is no longer suitable for providing the courses, we may provide access to the purchased course content through another suitable platform or delivery method. This may require customers to create a new account, reset login details, or access the course through a different website, app, or technical system.
We may update, modify, restructure, replace, or remove individual features, lessons, exercises, downloads, or technical functions where this is necessary or reasonable for technical, legal, security, quality, pedagogical, or business reasons, provided that the essential course content and the customer’s statutory rights are not unreasonably affected.
Nothing in this section limits your statutory consumer rights.
8. Statutory right of withdrawal (EU consumers)
EU consumers have a 14‑day right to withdraw from this contract without giving reasons. The period starts on the day the contract is concluded. The right expires once we have begun performance if you have expressly consented to the start before the end of the withdrawal period and acknowledged losing your right upon start. If you do not consent, we will provide access after the withdrawal period ends or limited preview access.

10. Exam-based refund guaranteed ("Pass or full refund")
If a customer completes all lessons and required assessment components of a SpeedyGerman course and does not pass the corresponding Goethe-Institut language exam (Goethe-Zertifikat), the customer may request a refund within seven (7) days of receiving the official exam result.
This guarantee applies exclusively to official Goethe-Institut exams. Exams from other providers, including but not limited to telc, ÖSD, TestDaF, or other institutions, are not eligible for the exam-based refund guarantee, even if aligned to the same CEFR level.
The exam-based refund guarantee is valid for twenty-four (24) months from the original date of purchase. After this period, the customer may continue using the course materials if lifetime access is included, but refund guarantee eligibility expires.
The exam must be taken within twelve (12) weeks of completing the corresponding course level and within the twenty-four (24) month guarantee period.
“Completion” means that at least 95% of all lessons, quizzes, assignments, and mandatory assessment components of the corresponding course level were completed through the learning platform before the exam date.
Course progress must show consistent engagement over time. Completing large portions of the course immediately before requesting a refund may invalidate eligibility.
The guarantee applies only to the first eligible exam attempt after course completion.
Proof of exam participation and the official exam result must be provided. Refund requests must be submitted to germanyfastlane(at)gmail.com and must include order details and valid documentation.
We reserve the right to verify the authenticity of all submitted documents and to reject refund requests where reasonable doubt exists.
We reserve the right to deny refund requests in cases of suspected abuse, fraud, bad faith behavior, account sharing, or manipulation of course progress data.
Refunds are granted once per customer. Approved refunds are issued to the original payment method within five (5) business days.
For course bundles, the exam-based refund applies based on the first failed eligible exam level.
If a customer purchases a bundle containing multiple course levels and fails the first course level included in the bundle, the refund may apply to the full remaining bundle amount, provided that the higher course levels have not yet been completed beyond reasonable introductory use.
For example, if a customer purchases an A1–A2–B1 bundle and fails the A1 Goethe exam, the customer may be eligible for a refund of the full bundle amount because the higher levels remain unused.
However, if a customer purchases the same A1–A2–B1 bundle, successfully completes A1 and A2, but later fails the B1 Goethe exam, the refund is limited to the proportional value of the B1 course level only.
For bundles containing multiple course levels, refunds are calculated proportionally based on the number of included course levels that remain refundable. For example, if a bundle contains two course levels, the refundable amount for one eligible failed level is generally limited to 50% of the bundle purchase price. If a bundle contains four course levels, the refundable amount for one eligible failed level is generally limited to 25% of the bundle purchase price.
Upon approval of a refund, access to all refunded course levels is revoked. Access to successfully completed and non-refunded course levels remains unchanged.
11. Intellectual property
All course materials are protected by copyright. You receive a licence for personal study only. Public sharing or resale is prohibited. We may use technical measures to protect content.
12. User conduct
You must not share accounts, answers, or files. Circumventing protection measures is prohibited. We may suspend or terminate access for violations.
13. Disclaimers and limitation of liability
Our courses are for educational purposes and do not guarantee specific results. We are liable without limitation for intent, gross negligence, injury to life, body, health, and under the Product Liability Act. For slight negligence, liability is limited to essential duties and typical foreseeable damage.
We are not responsible for the availability, scheduling, or pricing of external language exams administered by third parties such as Goethe-Institut, telc, or TestDaF. Course completion does not include or guarantee registration in these exams.
14. Promotional communications and affiliates
If you join our newsletter or follow affiliate links, our Privacy Policy applies. Advertising and affiliate recommendations are clearly marked.
15. Consumer dispute resolution
We are not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
16. Governing law and venue
These Terms are governed by German law. If you are a consumer in the EU, you also benefit from mandatory consumer protections of your home country. Exclusive jurisdiction for merchants is Munich, Germany.
For customers outside the EU, these Terms are governed exclusively by German law without regard to conflict-of-law principles. The place of jurisdiction for all disputes is Munich, Germany.
17. Changes to these Terms
We may update these Terms. Material changes will be notified in advance. The current version is always available on our website.
